Holy S*!T (I don’t even use that word)

Am I about to make history??

I filed a civil lawsuit against CitiMortgage, Inc. and Skyway Realty.  I always expected to win, they were responsible for the loss of my Personal Property, but what I didn’t expect…….man, the ride was a trip (I know, corny, sorry).

So, the Realtor fell by the wayside early, filed for bankruptcy and became irrelevant, but Citi????  Well, they played hard ball.  They played CRACK BALL, they played dirty.  They abused the litigation process, misused the discovery process you wouldn’t believe  the “kiddie discovery” request they served on my 14 year old (ridiculous).  They withheld documents from discovery responses, redacted whatever they wanted, and they served me “crap” in response to me request for production of documents (sure, maybe you can see it, maybe.  But can you PRINT it?)

When they ran out of tricks in Los Angeles Superior Court, they removed the case to Federal Court, effective to delay the case almost another year, but when the Federal Court Judge remanded the case back to Los Angeles Superior Court, they picked up where they left off.  But not before bringing in TWO new attorneys, “bet the company” attorneys, Rik Tozzi and Bryan Balogh from Burr Foreman joined Wolfe & Wyman partner Cathy Granger to beat up on me further.

I was sad and disillusioned when I realized that even the judge seemed joined the Citimortgage “dream team” of attorney partners, looking to put me in my place, but there was really nothing I could do but resolved to stand in my truth and fight to get from behind all the legal maneuvering and get in front of a jury of MY peers.

Oh, back to the journey.  FINALLY, in September 2015 (the case was filed in May 2012), Citimortgage, Inc. filed an ANSWER to the complaint.  On October 2015, I deposed the Real Estate Broker.  I know, right????  (Oh, he filed for bankruptcy to avoid a judgement from me in September 2012).   He acted like an angry troll during the deposition and answered the questions (well, not exactly answered.  It’s a 80 page read, but you decided, I don’t want to get in trouble) like he thought the transcript would never see the light of day.  Ooops.

But here’s where it really get’s surreal.  On April 19, 2016, I deposed my first employee of Citimortgage and on April 21, 22 and 26, 2016, I deposed three more of their employees.  It took a lot of work to get the to present the employees for deposition, I’m guessing they didn’t intend to ever do so, and tried to get away with ignoring my request.

So here we are, I plan to do one more deposition of a Citimortgage employee, I’m sending out about ten final subpoenas and I’m drafting my response to Citi’s Motion for Summary Judgement.  Discovery closes in thirty days and trial begins in sixty days.  I’m overwhelmed with the magnitude of it all, but I will continue to stand.  I still worry that the judge will try to dismiss my case by granting the summary judgement, but I have a huge surprise for her on hearing day (a date that was changed without me getting notice).

So, in the words of Mike Goldberg, “Here We Go”.  And when I win, and I believe I will win, I want to be a guest of honor at UFC 200.

I’m adding my gofundme link because this has definitely been expensive, but more than anything, I’m asking anyone who reads this and is available and/or local to join me in court on May 25, 2016 to “watch” the judge rule on the Motion for Summary Judgement and to make sure I don’t faint, seriously though, I could use the moral support for the Summary Judgement hearing AND the trial on June 27, 2016.

Wow, is this real??  Cause I keep expecting to find a database in the deep web of like 300 trials with a Pro Se Plaintiff and large corporate defendants.
